Workers’ Compensation claims are controlled in this state by the North Carolina Workers’ Compensation Act. This Act sets forth the requirements for having a compensable claim, and provides the benefits injured employees are entitled to.
REQUIREMENTS:
In order to have a workers’ compensation claim, the employer must first be covered by The Workers’ Compensation Act and the employee must be injured by an accident, a specific traumatic incident if the back is involved, or suffer from an occupational disease. The injury or occupational disease must arise out of, and occur in, the course of the employment.
BENEFITS:
Workers' compensation benefits consist of three basic types of benefits: (1) medical, (2) wage loss, and (3) payment for any permanent impairment. The type and extent of medical benefits, and the amount and payment of wage loss and permanent impairment benefits depends on the facts and circumstances of each claim.
